Performer Hire Terms & Conditions

 

General – These terms & conditions apply to all contracts entered into by Pole Twisters unless stated in the Pole Twisters quotation.  Any offer of equipment is subject to equipment being available on receipt of an order.  The hirer is responsible for making the venue aware of set-up and pick-up times and safe entry.

Age Limits - Some acts may require a minimum age limit of 18 yrs & over, please state if your event is family or adult orientated.  Pole Twisters ltd reserves the right to stop a performance at any time if the performer feels certain of any under-age person/s. 

Code of Conduct - Please be polite to our performers as they will be to you and please refrain from propositioning our performers as this may result in the cancellation of the performance with no refund.  The organiser of the event is responsible for the performer’s safety unless Pole Twisters ltd have provided security. 

Loss or Damages - Pole Twisters ltd accepts no responsibility for losses or damages incurred throughout a performance unless the performer is deemed liable through negligence.  If any persons at the event damages any equipment or property of Pole Twisters, the organiser is deemed liable to replace any damaged equipment and will be charged accordingly.  Where the Performer will clean & tidy the space used to the best of her ability, The Client is responsible to also clean up any spillages the performer makes or any marks/mess to the venue during or after the performance/act.

Insurance - All prices quoted include fully comprehensive public liability insurance of up to 5 Million plus costumes, equipment hire and local travel.  Please let us know if you require a copy of this.

Pictures/Videos - Where The Artist's performance at an event is recorded, in whole or in part, The Artist hereby releases The Client to use such recordings for it's own promotion only. If The Artist's performances are recorded for other purposes, The Client (and others employed by The Client) agrees to obtain an additional release from The Artist prior to the use of any such recordings. The Artist reserves the right to obtain and use any photographs / video footage taken at the event, with appropriate copyright procedure being followed.

Payments – Deposits are 50% of total quotation (unless otherwise agreed).  Deposits paid secure your hire booking for the date of your event and are non-refundable.  Remainder payment is required 7 days prior to event date or cash on arrival (as previously agreed).  All replies & confirmation are made by email and/or telephone. 

Cancellations - If you wish to cancel your booking after making a full payment, a 50% refund will be made through way of a cheque.  All cancellations must be made in writing or by email.  Some performers may have specific cancellation periods and if this is the case, their terms & conditions will be forward on to the client/hirer.

Late Arrivals – Pole Twisters ltd cannot be responsible for making up time if the clients group is late.  However if the performer arrives late, time will be made up. 

Date/Time Changes – Changes can be made to the performers start time or date, however there will be an admin charge of £10. 

Alcohol – Performers are advised not to drink alcohol, however if they do wish to do so, are always advised by Pole Twisters to drink sensibly.  If performers are unfit to perform due to intoxication, the client/hirer is advised to not pay the performer and/or request a refund in cases where the full payment was made in advance.  Please note, refunds are not payable if the performer has performed his/her act and you decide this afterwards.

Duties of the Performer - The Performer will render his/her services in a competent manner, arrive and perform at times specified between the parties, abide by all reasonable rules and requirements that The Client shall make, and as long as The Client fully performs its obligations hereunder, render services exclusively for The Client during the term of this contract.

Duties of the Client - The Client will provide a stage / performance area at the event, where The Artist shall perform. Also provided, shall be a secure changing area where The Artist can change between performances and safely store costumes / props for the duration of the event. The Client will also provide a suitable music system to The Artist’s routine music. An able person will be provided to collect The Artist’s costumes to be returned to The Artist after each routine. Any damages/losses not attributed to the use by The Artist will be reimbursed

Site Conditions – Pole Twisters quotation for hire charges is dependent on a suitable room (including suitable ceilings & flooring if poles are required) being provided.  Pole Twisters cannot be held responsible for damage caused to features in the property unless their positions have been clearly notified to Pole Twisters.  The hire charges do not include any repairs or making good that may be required to the room. 

Damage – The hirer shall ensure that equipment is used only in accordance with the directions of Pole Twisters.  Any damage caused through negligence shall result in costs for repair and/or new equipment.

Health & Safety – The hirer shall ensure that equipment is used only in accordance with the directions of Pole Twisters.

Third Party Liability – Pole Twisters will not be responsible for, and the hirer will indemnify Pole Twisters against, all claims for injury to persons, or loss of, or damage to, property, however caused, unless it be proved that such injury or damage resulted from faulty materials, workmanship, or negligence on the part of Pole Twisters.

Force Majeure – Whilst every effort will be made by Pole Twisters to complete any orders, Pole Twisters cannot be held liable for variation or non-completion of orders due to Act of God, Fire, Flood, Storm, Gale, Tempest, War, Pandemic, Terrorism, Strikes, Riots, Lockouts or any other civil disturbances.

Disclaimers - Upon payment of deposit and/or full payment The Client is hereby confirming to agree to these website terms & conditions and agree to abide by them for the duration of this contract.
